President Joe Biden was just a “sympathetic, well-meaning elderly man with a poor memory.” At least that’s how Special Counsel Robert Hur described the Autopen President. Hur concluded as much in his that let Biden off the hook for mishandling classified documents because a liberal Washington, D.C., jury would most likely not convict the senile old man.

Now, the long-awaited release of the audio recordings of Biden’s conversations with his memoir ghostwriter paints a picture of a politician in the throes of cognitive decline before he became commander-in-chief — a former vice president who broke the law and got away with it. 

Early Signs of Decline

The recordings come compliments of the Oversight Project, a government watchdog that fought in courtrooms for more than two years to bring them to the public.   

“We filed this case on March 6, 2024. It has been a very long, hard fight for transparency,” Kyle Brosnan, the Oversight Project’s general counsel said Tuesday in an interview on The Dan O’Donnell Show

All six audio files, more than two hours of Biden losing his train of thought to contracted writer Mark Zwonitzer, are available on the Oversight Project’s website. The page also includes a searchable transcript of the conversations. 

In his 2023 interview with Hurr, Biden showed what the Democratic Party and corporate media outlets labored to cover up: a president in steep cognitive decline. They attacked Hur, a former attorney in President Donald Trump’s Department of Justice, accusing him of running a politically motivated investigation. Vice President Kamala Harris at the time was one of the most vehement defenders of her boss, calling Hur’s report “inaccurate and inappropriate.” 

“The way that the President’s demeanor in that report was characterized could not be more wrong on the facts,” she said. It was all so “gratuitous” Harris said. Of course, later that year Biden’s ever-loyal vice president would be anointed as a presidential candidate after the Democratic National Committee threw the old codger under the bus when his senility became impossible to hide.  

The sessions with his ghostwriter point to where Biden was heading in the days immediately following his two terms as President Barack Obama’s No. 2. He meanders and forgets key facts. In one portion, Biden can’t remember the name of Rep. James Clyburn, the South Carolina Democrat who saved Biden’s bacon in 2020, when his goose seemed cooked in the early primaries. 

“These tapes show that the autopen presidency was not born when he was inaugurated president in 2021 but in the intervening years between when he left as vice president and the 2020 election,” Brosnan said. 

‘The Swamp Always Wins’

More damning is that the new audio details in real time the future president’s disregard for the laws on classified documents. 

While “sympathetic” Biden was treated with kid gloves, Trump was subjected to a 40-count superseding indictment and prosecution by Special Counsel Jack Smith, who ignored the law to get his man. Biden showed up on 60 Minutes to blast Trump for his handling of classified documents.

“How could that possibly happen?” Biden said. “How anyone could be that irresponsible?”

We would learn not long after that the Democrat was about to have to answer his own question.

As Brosnan notes, Trump was president and a former president when he declassified the documents Biden’s FBI found at his Mar-a-Lago home. 

Biden, on the other hand, had no authority to declassify, hold on to, and share classified records with ghostwriters. 

“There’s a big difference between the president and the vice president. And there are also multiple points throughout the audio where Biden himself says, ‘Oh boy, I’m not supposed to have this. Or ‘Hey, this is classified,’” Brosnan said. 

At a 2024 Judiciary Committee hearing into the Hur investigation, chairman Jim Jordan said that the matter “boiled down to a few key facts.” 

“Joe Biden kept classified information. Joe Biden failed to properly secure classified information and Joe Biden shared classified information with people he wasn’t supposed to. Joe Biden broke the law because he’s a forgetful old man who would appear sympathetic to a jury. Mr. Hur chose not to bring charges,” Jordan said. 

Brosnan said there’s a bigger reason why Biden got a pass: a two-tiered justice system driven by politics. 

“Because the swamp always wins,” the attorney said. “I mean this is coming of the heels of Hilary Clinton and her private email server and the declination to prosecute her.”

“There’s a two-tier system of justice in this country where Republicans get thrown through the ringer, whether it be Jack Smith’s prosecution of Trump or all the barfare against people like my colleague Jeff Clark or Dr. John Eastman,” he added.
