In a major blow to American sovereignty, the U.S. Supreme Court ruled on Tuesday that children born to illegal aliens and foreign \u201cbirth tourists\u201d on U.S. soil are citizens under the 14th Amendment. Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch dissented, while Justice Brett Kavanaugh concurred in the court\u2019s judgement and dissented in part.<\/p>\n

The case known as Trump v. Barbara<\/em> came to fruition last year, when Trump signed an executive order barring the federal government from producing or accepting certain documents purporting to recognize these birthplace citizens. The directive was immediately challenged in court by proponents of granting citizenship to the children of illegal aliens born on U.S. soil. <\/p>\n

Writing for the majority, Chief Justice John Roberts that the children born to parents \u201cunlawfully or temporarily present in the United States\u201d \u201csatisfy both elements\u201d of the 14th Amendment\u2019s citizenship clause: \u201cthey are \u2018born . . . in the United States\u2019 and \u2018subject to the jurisdiction thereof.’\u201d Therefore, he reasoned, \u201cthey are citizens at birth\u201d under the Constitution. <\/p>\n

\u201cCitizenship, then and now, was the right to have rights \u2014 to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to \u2018every free-born person in this land.\u2019 \u2026 We keep that promise today,\u201d Roberts wrote. <\/p>\n

Justice Ketanji Brown Jackson authored a concurring opinion, which Justice Sonia Sotomayor joined in part. The Biden appointee specifically criticized Thomas\u2019 dissenting opinion and the government\u2019s position as one that \u201cpropose[s] a return\u201d to the \u201ccore tenet\u201d of the Supreme Court\u2019s 1857 Dred Scott v. Sanford<\/em> decision, which held that black Americans \u2014 whether freed or enslaved \u2014 were not U.S. citizens. <\/p>\n

In his concurrence, Kavanaugh said that Trump\u2019s executive order violated federal law, but not the 14th Amendment. In agreeing with the dissent that there is no constitutional \u201cbirthplace citizenship\u201d right, he argued that \u201cCongress could \u2014 consistent with the Fourteenth Amendment \u2014 amend [the law] or otherwise enact new legislation establishing exceptions to birthright citizenship for children born to foreign citizens unlawfully or temporarily in the country.\u201d<\/p>\n

In his blistering dissent, Thomas (while joined by Gorsuch) blasted the majority\u2019s account for not being \u201chistorically accurate.\u201d He emphasized that the court\u2019s Barbara<\/em> decision \u201cadds to the sad history of the Fourteenth Amendment, which was designed and understood to secure equal rights for the freed blacks but has instead been repurposed for political projects that the Reconstruction Congress did not support.\u201d<\/p>\n

\u201cI am not sure that today\u2019s opinion will stand the test of time. The Citizenship Clause \u2018added greatly to the dignity and glory of American citizenship.\u2019 \u2026 Today\u2019s opinion devalues that citizenship. I respectfully dissent,\u201d Thomas wrote. <\/p>\n

In describing the Barbara<\/em> case as \u201cone of the most important decisions in the history of the Court,\u201d Alito noted in his dissent that the majority\u2019s ruling is a \u201cserious mistake.\u201d He underscored how the holding that \u201cvirtually everyone who happens to be born in this country\u201d grants citizenship to the children of \u201cbirth tourists\u201d \u2014 \u201cwomen who come here solely for the purpose of giving birth to a child and then promptly return home.\u201d Contrary to the court\u2019s ruling, he said, \u201cthe Fourteenth Amendment confers citizenship on only those children who, at birth, owe allegiance solely to this country.\u201d<\/p>\n

\u201cThe Court\u2019s interpretation preserves a powerful incentive to enter or remain in this country illegally. Immigrants naturally prefer affluent countries where economic opportunities are available. Other than Canada, the United States will be the only affluent nation where birth alone is enough to establish citizenship,\u201d Alito wrote. \u201cIf the Fourteenth Amendment required these results, the country would have to live with them or amend the Constitution. But the Fourteenth Amendment does not include the rule the Court now imposes on the country. In my judgment, the Court has made a mistake that will seriously affect the country\u2019s future.\u201d<\/p>\n

Gorsuch also authored a short dissent explaining why he and Thomas\u2019 views of the citizenship clause are consistent with the Supreme Court\u2019s 1898 U.S. v. Wong Kim Ark<\/em> decision, which held that the children of lawful permanent residents of America are citizens. He also outlined why respondents\u2019 facial challenge to Trump\u2019s executive order \u201cmust fail.\u201d <\/p>\n
